The terms and conditions below explain how we process our orders and how we handle returns, exchanges, and refunds. Please review them carefully to ensure that you agree with our sales terms and conditions. All use of this site for monetary transactions including the placing of any on-line orders, donations or bids, indicates your acceptance of the terms and conditions listed below. Please read the following policies, terms and conditions before proceeding with any of the aforementioned activities. These terms and conditions shall supersede all policies published on past web documents, sales receipts, and emails. Patuxent Riverkeeper reserves the right to make changes to this site and these terms and conditions at any time without notice.
PRIVACY POLICY
Patuxent Riverkeeper and its staff value your privacy. Your personal information is for use by our staff in order to serve you. This information is kept on a secure server to protect it from outside parties, and is information used for the limited purpose of processing your order(s). Information may also be used for statistical purposes, to improve our web site and services to you, to administer our site, and to notify you of products or special offers that may be of interest to you. Your personal information will not be sold or shared with third parties.
ORDER ACCEPTANCE POLICY
Your emailed receipt of an order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. Some items promoted and posted on our web site for sale have been donated to us, are used and are offered generally in an as-is condition unless clearly stated otherwise. Patuxent Riverkeeper may require additional information and/or verification before accepting and processing any order. Patuxent Riverkeeper urges you to confirm your purchase and personal information before submitting any orders.
CREDIT CARDS
Patuxent Riverkeeper accepts all major credit cards, and there is no surcharge for using your credit card to make a purchase. All transactions are in US dollars and processed by a US Bank. International orders will be charged in US dollars and the actual charge depends on the daily US dollar conversion rate for your currency. Please be sure to provide the exact billing address and telephone number as recorded with your credit card issuing bank. We will ship to an alternate address only if the billing address is on file with your credit card issuing bank. Incorrect information may cause a delay in the processing of your order. All orders are charged to the credit card you indicate at the time of your purchase. In order to track availability of purchased products, place orders, and expedite the processing of your order in general, your order must be fully paid at the time you place it.
ORDER CANCELLATION
Any order submitted through this website, if in stock, will ship immediately and cannot be cancelled. If the item is not in stock the order may be cancelled within seven days from the date of purchase at the request of the client by calling (301-249-8200) or by sending an email to info@paxriverkeeper.org Charge backs from credit card issuing banks are subject to the above policies.
BACKORDERS
Patuxent Riverkeeper will accept orders for out of stock items. If an item in your order is not in stock, it will be placed on backorder and shipped to you when it becomes available. Shipping charges are non-refundable. A backorder may be canceled at any time prior to shipping. In stock items cannot be canceled after order completion. We cannot cancel orders that are in transit from us to you.
RETURN POLICY
All returns are subject to approval after contacting the Patuxent Riverkeeper by phone or email. RETURNS WILL NOT BE ACCEPTED WITHOUT PRIOR APPROVAL BY OUR US. Shipping costs are not refundable except for defective items or items sent in error. Defective items will be exchanged for the same items. .
EXCHANGES
We will gladly exchange apparel and hats for different sizes. You will be responsible however for paying our postage cost for resending you the exchanged item.
SHIPPING POLICY
Shipping charges are calculated based on the total weight of all items in your order. The shipping cost charged at the time of purchase represents an estimate using standard Air Mail or US Priority Mail. Requests for Express Mail Service or special handling will be billed separately based on published rates plus small shipping and handling fee. If a backordered item is cancelled, Patuxent Riverkeeper will refund the difference in shipping charges from the items shipped and the freight charged. Shipping charges are non-refundable. An additional charge of $5.00 will be charged to your credit card for any refused or returned (as "undeliverable") shipment. Choosing Overnight or 2-Day Delivery does not mean your order will be delivered 1 or 2 days from the time you place your order. Selecting either of these shipping options simply means that you will receive your order 1-2 days after your order has been verified and processed by our Order Processing Department. Every effort is made to process all orders within 24 hours after receiving an order, but same-day shipping is not guaranteed. Patuxent Riverkeeper reserves the right to ship packages "best way" according to the shipper’s delivery schedules.
SALES TAX
Patuxent Riverkeeper only charges sales tax on shipments to Maryland and only then where applicable by law. You, the customer, are responsible for any and all unpaid sales taxes.
DISCLAIMER
Patuxent Riverkeeper makes no representations or warranties, either express or implied, of any sort with respect to the Patuxent Riverkeeper web sites, materials, their operation, information, or content. You, the purchaser, agree that Patuxent Riverkeeper, its directors, officers, employees and/or representatives, shall not be liable for damages arising from the operation, content, or use of the Patuxent Riverkeeper sites or the products or services sold therein. You agree that this limitation of liability is comprehensive and applies to all damages of any sort, including without limitation direct, indirect, compensatory, special, incidental, punitive and consequential damages.
JURISDICTION
Any litigation regarding this agreement or any transaction between a customer and Patuxent Riverkeeper shall be brought to the state or federal courts located in Prince George’s County, MD. The customer hereby agrees and submits to such jurisdiction and venue as proper.
COMPATIBILITY
As Patuxent Riverkeeper is not the manufacturer of any product we sell, we make no representations, guarantees or warranties of any kind, either expressed or implied, and assume no liability for any financial loss or damage caused by a product purchased from us. The sole and exclusive maximum liability to Patuxent Riverkeeper arising from any products sold on this site shall be the price of the product ordered, if found liable. In no event shall Patuxent Riverkeeper, its directors, officers, employees and/or representatives be liable for special, indirect, consequential, or punitive damages relating to the compatibility of products sold.
TYPOGRAPHICAL ERRORS
In the event a product is listed at an incorrect price due to typographical error or error in pricing information received from our suppliers, Patuxent Riverkeeper shall have the right to refuse or cancel any orders placed for products listed at the incorrect price without prior notification. Patuxent Riverkeeper shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and the order is canceled, Patuxent Riverkeeper shall immediately issue a credit to the credit card account in the amount of the incorrect price.
